§ 1. Prohibition of Disclosure

All information, including property details provided by the real estate agent, is intended solely for the client. The client is expressly prohibited from disclosing property details and information to third parties without the agent's prior express consent. Should the client breach this obligation and a third party, or any person to whom the third party has subsequently disclosed the information, concludes the main contract, the client is obligated to pay the agreed commission plus VAT.

§ 2 Dual Job

The real estate agent is entitled to work for both the seller and the buyer on a commission basis.

§ 3 Owner Information

The real estate agent points out that the property information provided originates from the seller or a third party commissioned by the seller and has not been verified for accuracy by the agent. It is the client's responsibility to verify this information. The agent, who is merely passing on this information, assumes no liability whatsoever for its accuracy.

§4 Limitation of Liability

The broker's liability is limited to grossly negligent or intentional conduct, provided that the client does not suffer bodily injury or lose his life as a result of the broker's conduct.

§ 5 Money Laundering Prevention

We are obligated, in accordance with the Money Laundering Act (GWG), to determine and store the identity of the contracting parties, their representatives, and beneficial owners when initiating a specific purchase agreement, as part of money laundering prevention measures. Our contractual partners are obligated under Section 11 of the GWG to support us in fulfilling this legal obligation.

§ 6 Statute of Limitations

The limitation period for all claims for damages by the client against the broker is three years. It begins when the act giving rise to the claim for damages was committed. Should the statutory limitation periods result in a shorter limitation period for the broker in a specific case, those statutory periods shall apply.

§ 7 Place of jurisdiction

If the broker and the client are both merchants within the meaning of the German Commercial Code, the place of performance for all obligations and claims arising from the contractual relationship and the place of jurisdiction shall be the broker's registered office.

§ 8 Consumer Arbitration Board

The European Commission provides a platform for online dispute resolution at http://ec.europa.eu/consumers/odr . Consumers can use this platform to resolve their disputes. However, our company is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.
